Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded.
10. Indemnification
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless RP Nutrients, its affiliates, officers, directors, employees, agents, representatives, licensors, and service providers from and against third-party claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to your violation of these Terms, misuse of the Website, violation of applicable law, or violation of the rights of another person or entity.

The governing-law and dispute-resolution provisions contained in those agreements will control disputes arising from the applicable transaction or product relationship to the extent permitted by applicable law.
Nothing in these Terms is intended to deprive any person of rights or protections that cannot lawfully be waived or limited.
13. Severability, Waiver, and Entire Agreement
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.
RP Nutrients’ failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.
These Terms, together with policies expressly incorporated into them, constitute the entire agreement between you and RP Nutrients concerning your use of the Website and supersede prior or contemporaneous understandings concerning that subject matter, except where a separate written agreement expressly governs a particular transaction or relationship.
